Terms and Conditions for Job Seekers

Welcome to Sapital Recruitments. These Terms and Conditions govern your use of our recruitment services. By registering on our platform, applying for jobs, or engaging with any of our offerings, you agree to abide by the following terms. These are designed to ensure transparency, fairness, and professionalism in all interactions between job seekers and our organization.


1. Service Overview

Sapital Recruitments offers professional job placement and recruitment consulting services to individuals seeking employment. Our team connects job seekers with employers across a range of industries, assisting with resume forwarding, interview scheduling, and career guidance. Please note that our services are not free, and associated fees and obligations are outlined below.


2. Registration and Service Fees

To initiate the process with Sapital Recruitments, candidates must register by choosing one of the following service plans:

  • Option 1: ₹300 + GST (Valid for 3 months)
  • Option 2: ₹500 + GST (Valid for 6 months)

Refund and Adjustment Policy:

  • If no interview is arranged within 15 working days of registration, candidates are eligible for a full refund of the registration fee.
  • In case the candidate is successfully placed through our agency, the registration fee will be adjusted against the final placement fee (refer to Section 3).
  • Registration fees are non-transferable and cannot be carried over beyond the selected validity period.

3. Placement Fee & Payment Terms

Upon successful placement in a job through Sapital Recruitments:

  • The candidate agrees to pay a placement fee equivalent to 50% of their first-month gross salary.
  • This amount is payable within 24 to 48 hours of receiving the first salary from the employer.
  • Timely payment is mandatory. In the event of non-payment or delay, Sapital Recruitments reserves the right to contact the employer and request deduction of the due amount directly from the candidate’s salary.
  • Repeated payment defaults may result in suspension from future services and potential legal recovery procedures.

4. Documentation Requirements

Candidates are required to submit the following documents for verification post-placement or as requested during the process:

  • Proof of Residential Address (Aadhaar, Utility Bill, Rent Agreement, etc.)
  • KYC Documents (PAN Card, Aadhaar Card, Voter ID, or Passport)
  • Latest Resume
  • Recent Passport Size Photograph
  • Appointment/Offer Letter (post-joining, for placement verification)

Failure to provide required documentation may result in delays in processing or service withdrawal.


5. Application and Interview Conduct

Candidates are expected to maintain the highest level of professionalism during all stages of the recruitment process. The following behaviors may lead to immediate disqualification or rejection:

  • Submission of false or misleading information on resumes, applications, or during interviews.
  • Unprofessional conduct, including but not limited to rudeness, offensive language, or inappropriate behavior with employers or Sapital staff.
  • Failure to attend scheduled interviews without prior notice or valid reason.
  • Non-payment of service or placement fees within the stipulated timelines.

6. Offer Declination and Joining Policy

Job seekers are expected to honor offer acceptances. In the event that a candidate:

  • Declines an offer after accepting it, or
  • Fails to join on the mutually agreed joining date without giving at least 72 hours’ notice with valid justification,

He or she shall be liable to pay a consulting charge of ₹2,500 to cover the recruitment and coordination efforts made by Sapital Recruitments. Failure to pay this charge may result in disqualification from using future services.


7. Non-Guarantee of Employment

While Sapital Recruitments makes every effort to assist in finding suitable employment:

  • We do not guarantee placement, job offers, salary levels, or employer commitments.
  • Final hiring decisions are at the discretion of the employer.
  • Sapital Recruitments shall not be held responsible for any post-joining disputes including changes in job role, salary, working conditions, or termination.

8. Confidentiality and Data Usage

  • All personal data submitted to Sapital Recruitments will be handled in accordance with our [Privacy Policy] and applicable data protection laws.
  • We will not share your information with third parties without your consent, except for the purpose of recruitment.
  • By registering, you consent to receive job alerts, interview notifications, and relevant updates via email, SMS, or phone.

9. Modification of Terms

Sapital Recruitments reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes will be posted on our website, and continued use of our services will constitute acceptance of the revised terms.


10. Limitation of Liability

Sapital Recruitments shall not be liable for:

  • Any loss, damage, or injury arising from employment obtained through our services.
  • Employer conduct or decisions post-placement.
  • Service interruptions due to technical errors, third-party systems, or unforeseen circumstances.

11. Termination of Services

Sapital Recruitments reserves the right to terminate or suspend services to any job seeker who:

  • Violates these terms and conditions,
  • Engages in fraudulent or unethical behavior,
  • Attempts to manipulate the recruitment process, or
  • Fails to make payments when due.

12. Dispute Resolution

In case of any dispute or disagreement regarding our services, we encourage job seekers to reach out to us for resolution. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of competent courts located in [Insert City/State], India.

By registering and continuing to engage with Sapital Recruitments, you confirm that you have read, understood, and agreed to these Terms and Conditions. You also agree to abide by any future amendments made available on our website.

1. Definitions

  • Client: The individual or entity to whom Sapital Recruitments introduces candidates.
  • Consultancy Firm: Sapital Recruitments, providing recruitment and talent acquisition services.
  • Candidate: Any person introduced to the Client for potential engagement.
  • Candidate Information: Personal and professional information relating to a Candidate.
  • Introduction: Sharing candidate details or arranging interviews.
  • Placement Fees: Charges applicable upon successful candidate engagement.
  • Remuneration: Total annual gross compensation offered to a Candidate.

2. General Provisions

  • All business is subject to this Agreement unless otherwise stated in writing.
  • These terms override any prior agreements.
  • Either party may terminate this Agreement with 4 weeks’ written notice.
  • Changes to the Agreement must be approved in writing by Sapital Recruitments.
  • These terms are governed by applicable jurisdictional law.
  • Disputes shall be resolved through negotiation or arbitration.
  • If any clause is unenforceable, the remaining provisions shall remain valid.

3. Obligations of Sapital Recruitments

  • Conduct recruitment activities professionally and ethically.
  • Introduce suitable candidates to fill client vacancies.
  • No guarantee is made regarding candidate suitability or availability.
  • Maintain confidentiality of all client data, unless disclosure is required by law.
  • Comply with all data protection regulations.
  • Provide regular updates and communication.
  • Not liable for any candidate misrepresentation.

4. Client Obligations

  • Provide complete role details, employment terms, and any special requirements.
  • Designate a point of contact for recruitment coordination.
  • Independently verify candidate qualifications, references, permits, etc.
  • Notify Sapital of:
    • Any candidate engagement or offer made
    • Termination within the first 3 months
  • Engage Sapital exclusively for that vacancy; no use of other agencies or channels.
  • Provide timely feedback on interviews and profiles.
  • Conduct fair and lawful assessments/interviews.
  • Indemnify Sapital from liability arising from the misuse of candidate services.
  • Not contact candidates outside of this agreement.

5. Placement Fees

  • Fees are due upon the engagement of a candidate presented by Sapital.
  • If a candidate is engaged at a later date or via a third party, fees still apply.
  • Fees must be paid within 45 days of the invoice.
  • Interest may apply for late payments.
  • Standard Placement Fee:
    4.17% of the candidate’s annual remuneration or ₹2,000 minimum, whichever is higher.
  • Advertising costs are billed separately.
  • Sapital may adjust fees with 30 days’ notice.
  • Fees remain payable for any engagement made before contract termination.

6. Refunds & Replacements

  • If an engagement ends within 4 months, Sapital will:
    • Find a replacement within 45 days, or
    • Refund the Placement Fee
  • Refunds are not applicable for terminations due to illness, pregnancy, restructuring, or discrimination.
  • Refunds are only processed if original fees were paid on time.

7. Validity of Introductions

  • Candidate introductions remain valid for 12 months from:
    • Date of first submission
    • Last interaction/interview
  • If the client withholds remuneration info, Sapital may charge a fee based on market salary benchmarks.

8. Candidate Suitability

  • Sapital attempts to match candidates but cannot guarantee success.
  • Final verification (background, references, etc.) is the Client’s responsibility.
  • Written candidate consent is required for external checks.
  • Sapital is not liable for any unsuccessful placements.

9. Non-Solicitation

  • The Client shall not directly or indirectly engage or employ any candidate introduced by Sapital for 12 months unless through Sapital.
  • If violated, the full placement fee becomes immediately payable.
  • This clause remains effective even after agreement termination.

10. Data Protection

  • Both parties act as independent data controllers under GDPR and Indian data protection law.
  • Each must ensure personal data is handled in compliance with applicable regulations.
  • Reasonable assistance and cooperation must be provided on data protection matters.

11. Confidentiality

  • All information shared under this Agreement is confidential.
  • Candidate details must not be disclosed to third parties without permission.
  • No reproduction of confidential material unless essential to service.
  • Any legal disclosure requires prior consultation.
  • Breaches will trigger indemnification.

12. Force Majeure

  • Neither party is liable for failure to perform duties due to events beyond control (e.g., natural disasters, pandemics, strikes, etc.).
  • If such an event continues for over 60 days, either party may terminate this agreement with written notice.
  • Parties are expected to mitigate impact where possible.

13. Acceptance of Terms

  • The Client accepts these terms by:
    • Signing,
    • Confirming via email, or
    • Proceeding to use Sapital’s services in any form
  • Lack of signature does not invalidate enforceability if services are availed.
  • If the Client disagrees with any clause, they must notify Sapital in writing before continuing.

14. Liability & Severability

  • Sapital is not liable for losses or damages arising from recruitment services.
  • Both parties shall avoid causing data breaches or legal risk to the other.
  • Each party indemnifies the other against data-related losses or penalties.
  • If any term is unenforceable, the remaining agreement stays valid.
